Licensing Act 2003

The Licensing Act 2003 came into force on 24 November 2005.

The Act established a single integrated scheme for the licensing of premises, which are used for the supply of alcohol, to provide regulated entertainment or to provide late night refreshment.


The Act offers greater freedom and flexibility for the leisure and hospitality industry so that the public may be offered a greater choice, but these greater freedoms are balanced by providing tougher powers for local authorities and the police to deal with those who act against the public good.

The aims of the Licensing Act 2003

The act provides a balanced package of freedoms and safeguards.

It has an important role to play in the prevention of crime and disorder and public nuisance that may be perpetrated by a minority, and gives the responsible majority more freedom and choice about how they spend their leisure time.

The Act marked the end of the previous outdated licensing regimes.

The Licensing Objectives

Licensees will need to promote four fundamental objectives as follows:

  • the prevention of crime and disorder
  • public safety
  • the prevention of public nuisance
  • the protection of children from harm.

Under The Licensing Act 2003 Telford and Wrekin Council,acting as the Licensing Authority will assume responsibility for licensing all outlets within the borough that sell or supply alcohol, provide public entertainment, late night refreshment between the hours of 11pm and 5am.

Applications

Applications for licences required under the Licensing Act must be made to the Telford and Wrekin Council.

Applications can be made for:

  • Premises Licence
  • Personal Licence
  • Club Premises Certificate
  • Temporary Event Notice


We will also give you details of how interested parties and responsible authorities may make representations against an application once it has been made.

Statement of Licensing Policy

The Act requires the Licensing Authority to publish a Statement of Licensing Policy every 3 years and the current Telford and Wrekin Statement of Licensing Policy was published in January 2008.

In addition to this 3 yearly review, Telford and Wrekin Council are currently consulting on their Statement of Licensing Policy. The consultation period runs until 6th February 2009.
