Exempt buildings

Whilst not exhaustive the following list outlines the more common types of building work which are exempt from the requirements of the Building Regulations 2000 (as amended).
Important
These exemptions apply to the Building Regulations only and your attention is drawn to the fact that Planning Permission may be necessary.

Small detached buildings
A detached single storey building, having a floor area, which does not exceed 30m2, which contains no sleeping accommodation and is a building:-

(a) no point of which is less than one metre from the boundary of its curtilage; or

(b) which is constructed substantially of non-combustible material; and

(c) which complies with Part P (Electrical Safety).

A detached building, having a floor area which does not exceed 15m2, which contains no sleeping accommodation and complies with Part P (Electrical Safety).

Extensions
The extension of a building by the addition at ground level of:-

(a) a conservatory or porch providing that:

The floor area does not exceed 30m2.

All glazing satisfies the requirements of Part N.

It is positioned over and physically separated internally from the building it is attached to by a door.

It contains no sanitary appliances.

It is provided with separate temperature and on/off controls on any fixed heating.

It complies with Part P (Electrical Safety).

Note: `conservatory' means a single storey part of a building which has

  • not less than three quarters of its roof area and not less than one half of its external wall area made from translucent material and
  • is thermally separated from the dwelling by walls, windows and doors with U-value and draughtstripping provisions as least as good as provided elsewhere in the dwelling.


(b) a carport open on at least two sides providing that:

The floor area does not exceed 30m2.

It complies with Part P (Electrical Safety).


(c) a covered yard or covered way providing that:

The floor area does not exceed 30m2.

It complies with Part P (Electrical Safety).
