Consultations - Proposed Implementation of Designated Vehicles Listing, Section 167 Equality Act 2010

Who can get involved? Everybody but we particularly want to hear from people who require the use of accessible vehicles and members of the licensed vehicle trade.

Reason for consultation Section 167 Equality Act 2010 allows licensing authorities to maintain a list of designated vehicles, i.e. a list of wheelchair accessible hackney carriages and private hire vehicles licensed in their area. Whilst Local Authorities are under no specific legal obligation to maintain a list under the Act, the Government recommends strongly that they do so. We wish to find out the views of Members of the Public and Licence Holders before deciding whether to publish and maintain such a list.
Overview On 6th April 2017, section 165 and 167 of the Equality Act 2010 came into force.

Section 165 places duties on drivers of designated wheelchair accessible taxis and private hire vehicle.

Section 167 allows licensing authorities to maintain a list of designated vehicles, i.e. a list of wheelchair accessible hackney carriages and private hire vehicles licensed in their area. Whilst Local Authorities are under no specific legal obligation to maintain a list under the Act, the Government recommends strongly that they do so.

Telford & Wrekin Council is considering publishing and maintaining a designated list of vehicles under the provisions of s167 of the Equality Act 2010.

What happens next? Members of the Council’s Licensing Committee will consider a Report on 22nd January 2019. The report will include any comments received during the consultation process.
